1. Who we are and what these terms cover
IATA.co ("we", "us", "the Platform") operates the website at iata.co, the booking portal and the flights API (together, "the Services"). These Terms of Service ("Terms") govern every use of the Services. Additional documents form part of these Terms: the Privacy Policy, the Refunds, cancellations and changes policy, the API Terms of Use, the API rate limits and fair use page and the Acceptable Use Policy. If these Terms and one of those documents conflict, the more specific document applies to its subject.
IATA.co is an independent company. It is not the International Air Transport Association and is not affiliated with, endorsed by or operated by it.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter a binding contract. If you register on behalf of a business, you confirm that you have authority to bind it, and "you" means that business.
- You must give accurate, complete and current information at sign-up and keep it up to date: your name, your agency, your country, your phone number and your email address. We may suspend an account whose details are false or cannot be verified.
- One person may hold one account unless we agree otherwise in writing. An account may not be sold, transferred or shared with third parties.
- You are responsible for everything done through your account and your API keys, whether or not you authorised it, until you tell us that they have been compromised. Keep your password and keys secret.
- We may refuse, limit or close any account at our discretion, including where we suspect fraud, abuse, a breach of these Terms or a risk to the Platform, its suppliers or other customers.
3. Our role in a booking
When you book through the Services, the contract of carriage is between the passenger and the airline that operates the flight. We act as an intermediary that searches, prices and issues tickets through airline and consolidator systems on your instruction. We are not the carrier, we do not operate flights, and we do not control schedules, aircraft, seat availability, baggage allowances or the conduct of airline staff.
The airline's conditions of carriage and the fare rules attached to each ticket apply to the ticket. They decide whether a ticket can be changed or refunded, at what cost and within which time. We show the rules we receive before you confirm, and we apply them as written.
4. Your responsibilities when booking
- Passenger details. You must enter every passenger's name exactly as it appears on the travel document, together with correct dates of birth and document details where required. Name corrections after issue are subject to airline rules and fees, and some airlines do not permit them at all.
- Travel documents and entry rules. You and your passengers are responsible for passports, visas, health requirements and any other condition of entry or transit. We do not check them and we are not liable if a passenger is refused boarding or entry.
- Checking the booking. Review the itinerary, the dates, the times (shown in local time), the fare conditions and the total before you confirm. Once a ticket is issued the airline's rules apply immediately.
- Your customers. If you resell to your own customers, you are responsible for what you tell them, for collecting payment from them and for passing on schedule changes, cancellations and refunds we notify to you. Your terms with your customers do not bind us.
- Compliance. You must hold whatever licences and registrations the law of your country requires for selling travel, and you must comply with sanctions, anti-money-laundering and consumer laws that apply to you.
5. Fares, availability and errors
- A fare shown in search results is the price returned by a supplier at that moment. It is not guaranteed until the ticket is issued; airlines change prices and availability continuously and a fare can change or disappear between search and confirmation.
- All prices are shown in the Platform's main currency unless stated otherwise, and include the taxes and fees the supplier reports to us. Airport, baggage, seat or payment charges collected by the airline directly are not included unless shown.
- If a price is obviously wrong because of a technical, supplier or human error, we may cancel the booking and return the full amount charged to your balance, even after issue. We tell you as soon as we know.
- We may add a service fee to a booking. Any fee is shown separately before you confirm.
6. The prepaid balance
- Bookings are paid from a prepaid balance that you fund in advance. A booking cannot be issued for more than your available balance.
- Funds added to your balance are for use on the Services. The balance is not a bank account, earns no interest and is not insured as a deposit.
- Unused funds can be returned on request, subject to the refund policy, verification of your identity and the deduction of any amounts you owe us. We return funds by the method they were paid with, to the account they came from.
- A balance is not transferable to another account and cannot be used as security for a debt.
- We keep a ledger of every movement. If you believe an entry is wrong, tell us within 30 days of the entry; after that the ledger is taken as accepted.
- We may set off any amount you owe us (for example a debit memo raised by an airline for a booking you made) against your balance and we will tell you when we do.
7. The flights API
API access is granted per account after review and is subject to the API Terms of Use and the rate limits and fair use rules. We may change, limit, suspend or withdraw API access at any time for breach of those rules, for security reasons or where usage threatens the Platform or its suppliers. Bookings made through the API are governed by these Terms exactly as bookings made in the portal.
8. Acceptable use
You may not use the Services to do anything unlawful, to make speculative or fictitious bookings, to scrape or resell our data, to test fraudulently obtained payment instruments, or to interfere with the Platform or other users. The full rules are in the Acceptable Use Policy.
9. Intellectual property
The Platform, its software, design, documentation, text, images and data (other than airline and supplier content) belong to us or our licensors. You receive a limited, revocable, non-exclusive licence to use the Services for your business in accordance with these Terms. You may not copy, modify, reverse engineer, frame or create derivative works from the Platform. Airline names, codes and logos belong to the airlines and are shown only to identify carriers.
10. Availability and changes to the Services
We work to keep the Services available at all times but we do not promise uninterrupted or error-free operation. Suppliers, networks and airlines can fail independently of us. We may change, add or remove features, and we will give reasonable notice of changes that materially reduce what you can do, except where a change is required by law, by a supplier or for security.
11. Limitation of liability
- Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence or for fraud.
- Subject to that, we are not liable for the acts or omissions of any airline, consolidator, payment provider or other third party, including cancellations, delays, schedule changes, denied boarding, lost baggage, refusal of refunds or changes to fare rules.
- We are not liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill or loss of data, however arising.
- Our total liability to you for all claims arising out of or in connection with the Services in any twelve-month period is limited to the service fees you paid to us in that period, or, where no service fees were paid, to the equivalent of the balance you had on the Platform at the time of the event, whichever is lower.
- You agree to indemnify us against claims, losses and costs arising from your breach of these Terms, from information you provide, from your resale to your customers or from your use of the API.
12. Suspension and termination
You may close your account at any time from your account page or by writing to us; we will return any unused balance under the refund policy. We may suspend or close your account with notice for breach of these Terms, non-payment of amounts due, fraud or suspected fraud, a legal requirement, or prolonged inactivity. Sections that by their nature should survive (payments owed, liability, intellectual property, governing law) survive termination.
13. Privacy
How we handle personal data, including passenger data, is described in the Privacy Policy. By using the Services you agree to that handling. Where you give us personal data about other people, you confirm that you have the right to do so.
14. Changes to these Terms
We may update these Terms. The date at the top shows the current version. For material changes we will notify you by email or in your dashboard at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. Continuing to use the Services after the effective date means you accept the new Terms. If you do not accept them, close your account before that date.
15. Governing law and disputes
These Terms are governed by the laws of the country in which the operator of IATA.co is registered, without regard to conflict-of-law rules, and the courts of that country have exclusive jurisdiction, except that we may seek injunctive relief in any court to protect our intellectual property or the security of the Platform. Before starting proceedings, both parties agree to try to resolve the dispute by writing to the other and allowing 30 days for a response.
16. General
- These Terms and the documents they refer to are the entire agreement between you and us about the Services.
- If any part is found unenforceable, the rest remains in force.
- Our failure to enforce a right is not a waiver of it.
- You may not assign these Terms; we may assign them to a successor of our business with notice to you.
- Notices to us must be sent to info@iata.co; notices to you go to the email address on your account.
